Terms of Service

Welcome to Air Decants. By accessing or using airdecants.com (the "Platform"), you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the Platform.

1. About Air Decants

Air Decants is an online marketplace that connects independent fragrance decant sellers ("Sellers") with buyers ("Buyers"). Air Decants is not a seller of fragrance products. We provide the platform and technology; all fragrance decants are listed and fulfilled by independent Sellers.

2. Eligibility

You must be at least 18 years old to use Air Decants. By creating an account, you represent that you are 18 or older and that all information you provide is accurate and complete.

3. Accounts

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at contact@airdecants.com if you suspect unauthorized access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Buying on Air Decants

Orders and payment

When you place an order, you enter into a transaction directly with the Seller. Air Decants facilitates payment processing via Stripe. By purchasing, you authorize the charge to your selected payment method.

Return and refund policies

Each Seller sets their own return and refund policy. The policy in effect at the time of purchase applies to your order. Review the Seller's policy before purchasing. Air Decants is not responsible for Seller refund decisions, but we may mediate disputes at our discretion.

Decant authenticity

Sellers represent that all decants are sourced from genuine, authentic fragrances. Air Decants does not independently verify every product but will investigate reported authenticity concerns.

5. Selling on Air Decants

Seller approval

Selling on Air Decants requires approval. We reserve the right to approve or deny any seller application at our sole discretion.

Seller responsibilities

• Sellers must accurately describe all products, including fragrance name, brand, concentration, and vial size.
• All decants must be sourced from authentic, genuine fragrance bottles. Selling counterfeits or mislabeled products is strictly prohibited and will result in immediate removal.
• Sellers must fulfill orders within their stated processing time.
• Sellers must publish a return policy and honor it.
• Sellers must maintain sufficient inventory for active listings.

Fees and payouts

Air Decants charges a platform fee on each completed sale. The current fee rate is disclosed during seller onboarding and on the seller dashboard. Payouts are processed via Stripe Connect. Sellers are responsible for any applicable taxes on their earnings.

Prohibited listings

Sellers may not list: counterfeit or replica fragrances; products that have been adulterated, diluted beyond standard decant practice, or tampered with; or any product that violates applicable law.

6. Prohibited conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Circumvent or attempt to circumvent our payment system by transacting directly with Sellers outside the Platform.
• Post false, misleading, or defamatory reviews or content.
• Harass, threaten, or abuse other users.
• Scrape, crawl, or otherwise extract data from the Platform without written permission.
• Attempt to gain unauthorized access to any part of the Platform or its systems.

7. Intellectual property

The Air Decants name, logo, and site content (excluding Seller-uploaded content) are owned by Air Decants and may not be used without written permission. Sellers retain ownership of content they upload but grant Air Decants a non-exclusive, royalty-free license to display it on the Platform.

8. Disclaimers

The Platform is provided "as is" without warranties of any kind. Air Decants does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We are not responsible for the quality, safety, or legality of products listed by Sellers, or for Sellers' failure to fulfill orders.

9. Limitation of liability

To the fullest extent permitted by law, Air Decants' total liability to you for any claim arising from use of the Platform shall not exceed the greater of (a) the amount you paid to Air Decants in the twelve months preceding the claim, or (b) $100. In no event shall we be liable for indirect, incidental, special, or consequential damages.

10. Dispute resolution

Disputes between Buyers and Sellers should first be resolved directly between the parties. If unresolved, contact us at contact@airdecants.com and we will attempt to mediate in good faith. Any legal disputes arising from these Terms shall be governed by the laws of the State of California, and you consent to the exclusive jurisdiction of courts located therein.

11. Changes to these Terms

We may update these Terms at any time. Material changes will be communicated by email or a prominent site notice at least 14 days before taking effect. Continued use of the Platform after changes are effective constitutes acceptance.
